How Much Does Bankruptcy Cost?

We pride ourselves on providing excellent service at a fair price. We understand that our bankruptcy clients are coming to us because money is tight. Mr. McCullough offers the best value available because of his extensive experience, knowledge, and personal attention to each case.

A typical Chapter 7 bankruptcy case costs $1,600.* That includes everything, all attorney fees, the $338 filing fee, a comprehensive credit report, the pre-filing credit counseling course, and the post filing debtor education course. Most cases can even be filed upon payment of $1,200, with the filing fee paid over a 2 month period after filing.

By retaining our office you can avoid the biggest expense possible, a carelessly filed bankruptcy resulting in a denial of discharge or unkowingly being required to turn over thousands of dollars to the bankruptcy trustee.

Payment plans are available. If you are in an emergency situation we can usually file a basic bankruptcy petition for a small amount down to stop lawsuits and collections and discuss options to complete your case with installment payments after the initial filing. This option is a bit more complicated (and in the long run more expensive) but it's an option for those that need immediate relief with a chapter 7 bankruptcy and that have limited funds.

* Attorney fees may be lower or higher based upon your situation. Some cases are simply more complicated and time consuming than normal. When a business is involved, asset protection planning is necessary, or if other complications exist, additional fees may be charged. In these circumstances the fee paid will be well worth the money we save you with the additional services performed.

Chapter 13 is unique because the attorney fees are typically paid in part during the 3 to 5 year payment plan (averaging about $80/mo) and may actually reduce the amount of money paid to creditors. Your case may be filed for as little as $500 up front, depending on the situation. The court approved base attorney fees for Chapter 13 cases in Utah is $3,500 to $4,000, based on the complexity of the case.
